Clark Waddoups, of the Salt Lake City Federal Court, is expected to rule today on whether Bank of America and certain subsidiaries can move forward with foreclosures in the state of Utah. As [link=http://www.mortgageorb.com/e107_plugins/content/content.php?content.6049]reported[/link] earlier this week, 5th District Court Judge James L. Shumate in late May issued a preliminary injunction against Bank of America and ReconTrust prohibiting the companies from conducting trustee's sales on the basis that ReconTrust is not registered with the Utah Division of Corporations to do business in the state. Waddoups began reviewing oral and written testimony Thursday, after Bank of America had the case moved to federal court. According to television station KCSG, Waddoups is expected to issue his ruling today.
