Delaware Couple Wins Foreclosure Suit; Servicer Issues ‘Public Apology’

In what could be an unprecedented event in mortgage industry history, a Northeast Portland, Del., couple has reportedly won a public apology and out-of-court settlement from Delaware-based mortgage servicer Nationstar Mortgage Inc. after a fierce legal battle over a loan to update a house that had been in the family for more than 50 years.

Skanner News reports that Michael and Judith McEldery, along with their attorney, Michael Fuller, prevailed in the foreclosure suit after they were able to prove Nationstar had cashed their payment checks. It was reportedly the first time an apology has been issued as part of a resolution to a mortgage fraud case.
